1. Arrival and departure
In principle every day of the week is possible as arrival and/or departure day. The apartment rented by tenant is available from 2.00pm on the day rental period starts and must be abandoned on the last day of the rental period before 10.00am. Mentioned times will be strictly adhered by landlord due to often the direct following-up guests, the landlord will need the strict time to clean the apartments. If necessary, there is a possibility, to book an earlier check-in and/or late check-out against payment. However this is always in consultation with landlord and should be agreed in advance in writing between tenant and landlord. The fee for this is determined by landlord and will be between € 50,- and € 75,-.

2. Reservation
In principle the reservation of the apartment should be done via the booking form on the website. However, in consultation with the landlord, tenant may also make a reservation by telephone or email to landlord. These modes of booking are binding for the client/tenant. Landlord wants to point out that bookings made via the internet, makes a final reservation. The so-called cooling-off period which in the law is called buy on distance, does not apply to rent apartments via the website of landlord. Landlord always sends a confirmation via e-mail to tenant. In the same email will also be send the payment info. All specifications provided on the website of the landlord as well as in this rental conditions, are part of the lease agreement between tenant and landlord. Consequently, the tenant accepts these rental conditions unreserved. The payment by tenant to landlord applies in full acceptance of these rental conditions.

3. Prices
The use of duvets, pillow, bed linen, hand- and tea towels, as well as Wi-Fi internet and Satellite TV and the final cleaning are inclusive of the arranged rental price. Normal water and electricity usage is included in the rental price. However waste by landlord will be deducted from the deposit paid by tenant. Beach umbrellas etc. are available free of charge by landlord. Towels from the apartment may not be used on the beach or pool. By payment of € 3,- per week/per piece, landlord sets large beach-sheets available.

4. Deposit
Tenant agrees that there is a deposit of € 150,-that will be paid to landlord. Full refund of this deposit to tenant by landlord will in principle happen within 7 days after departure from the apartment of tenant after the rental period if no damage/breakages caused by tenant in the apartment. If this happens unexpected landlord must always inform directly the landlord/contact person. Landlord/contact person will directly check after departure of the tenant or the apartment is still in the same condition in which it wasfound as at check-in. If not, landlord will directly report imperfections on this per e-mail or telephone to tenant.

5. Number of guests
The rental price is based on the agreed number of guests by email, named in the booking by tenant and landlord. These are strictly in terms of name and number. The rented apartment may only be used by the tenant (s) and fellow tenant (s) and it is never allowed to rent the rented under or for purposes other than holiday stay. If there is room for multiple guests in the apartment, these guests have to pay an extra charge per person as listed on the website. In the e-mail confirmation of the booking is the total number of guestswill be mentioned. Babies no older than 1 year will be counted as a tenant, however, not included in the rental price. This applies if the baby on the day of departure from the apartment is not older than 1 year.

6. Payment
The total rent payment amount or a first deposit, has to be booked/transferred by tenant within five working days after receipt of the e-mail confirmation of bookingto the specified bank account. Immediately after receipt of the payment of tenant, landlord sends a payment confirmation by e-mail to tenant as well as all the other necessary information.

7. Payment in parts and payments on short term
Landlord requests tenant to make the total payment in one time. Payment in two parts is also possible. For the first term tenant pays 30% of the total rental amount. The remaining portion of the rent (70% of the total rent + deposit of € 150,-) tenant shall book/pay not later than 8 weeks prior to the start of the rental period. When booking within 8 weeks before the start of the rental period you will need to comply with the total amount in one time.

8. Cancellation by tenant
Tenant should be confirmed cancellation by telephone and in writing to landlord. The cancellation costsare to 8 weeks before the start of the rental period, 30% of the rental amount. From 8 to 4 weeks before start of the rental period, it will be 75% of the rental amount. With later cancellation, the entire rent will be due. For these costs the tenant can assure himself by means of cancellation insurance. Beside a travel insurance landlord urgently recommends to tenant a cancellation insurance.

9. Insurance
Landlord encourages tenant to always have a cancellation insurance (besides a travel insurance) to shut down, regardless of whether tenant going on vacation on long or short term. There is always a possibility something happens which can namely tenant forced to postpone the trip, cancel or abort.

10. Cancellation by landlord
If landlord due to circumstances beyond its debt is forced to cancel a reservation, or in the case of sale (or intent to sell and or activities relating to a sale) of the rented apartment, landlord will offer another apartment of a similar nature and price to tenant. Should this not be possible, the landlord will always repay the paid amount to tenant, however without compensation of direct damage and/or consequential damages (e.g. airline tickets/car rental etc.).

11. Babies
Babies under age of 1 year are counted in the total number of existing tenants in the rental price, however not counted in rental price. This applies if the baby on the day of departure from the apartment is not older than 1 year. Landlord will give on request, free available: baby bed including linen, high chair and dress-up pillow.

12. Pets
To bring a maximum of one pet (which may cause absolutely no nuisance to other guests/residents in Riomar) should always be requested in writing prior to the final booking. Landlord will decide in consultation with tenant. The additional costs of carrying this pet are € 25,- per week. Tenant should note that for dogs and cats may be a health declaration and a vaccination against rabies and must be able to submit proof.

13. Wi-FI (internet)/Satellite TV
Landlord cannot guarantee that the connection is always there and completely safe, nor that it is at any time at full bandwidth available. Landlord hires the services of an outside provider, which of course always will try to ensure as optimal connection. However it is possible that the connection is temporarily not functioning because of for example necessary maintenance, power failure or other disasters/required work, which are completely beyond our control. The use of Wi-Fi in Riomar is entirely at your own risk, which is common with use of data connections through (semi-) public networks. Landlord is not liable for damage to files or programs by viruses in the form of malware, adware, etc., or for any loss of your files in case of the (short/unexpected) failure or blocking the connection. Care for an adequate backup of your files. By using the free Wi-Fi connection and satellite TV in Riomar, you automatically agree with the rules and conditions as above.

14. Cleaning
The apartment is always completely clean delivered by landlord upon arrival in Riomar. If tenant staying longer than 8 days there will be for free an between-cleaning of Riomar as well as a linen change done by landlord. The final cleaning of the apartment is included in the price. Landlord of tenant expects that the apartment must be cleaned up at departure; wipe the apartment, do the dishes, undo the bedding, throw away rubbish etc.

15. Complaints
If there are complaints despite careful preparations and ensure by landlord, then the tenant, in the first instance, has to turn to the contact person in Riomar. If the complaint is not satisfactorily resolved, the tenant should contact landlord directly. The prematurely abandoned apartment by tenant without prior consultation and mutual understanding does not release landlord of any obligation to compensation. Complaints that are not satisfactory be solved must be submitted in writing to landlord within one week after the end of the rental period.

16. Liability
16.1 During the stay the tenant is liable for the apartment, the decoration and all the things that belong to the rented object. Any damage caused by the tenant or tenants must be immediately reported and compensated to the contact person in Riomar. If this damage exceeds the deposit already paid referred to in article 4, it shall be paid on the spot directly to the contact person. Immediately before the departure or directly after the departure of the tenant the contact person will thoroughly check the apartment.
16.2 Subject to legal liability, the landlord, will never be liable for loss, theft, damage and/or injury, caused to or by tenants and is therefore limited to the amount for the rented that has been paid. Landlord shall never be liable for indirect damage, including consequential and missed savings in any case.
16.3 In a later than agreed arrival or departure earlier than agreed by tenant from the apartment no claim to reimbursement by landlord can be claimed by the tenant of the “non enjoyed” time.
16.4 Landlord is entitled after a period of 24 hours after the agreed date of arrival to rent the apartment again to other tenats, if the tenant without message stays away and no further appointments were made.
16.5 Obvious errors or mistakes in the description, or prices of the apartments offered by landlord on the website or in the email correspondence will not bind landlord.The (price) information on the website is leading. Previously published (price) information expires with this.
16.6 Landlord is not liable for any harm resulting from natural disasters, violence, natural disasters, nuclear attacks, strikes, violence and other external factors such as breakdowns and outages of power and water facilities and technical installations.
16.7 It may happen that near Riomar work takes place such as construction work, road-(re) constructions or other activities. Landlord is not liable for any resulting inconvenience.
16.8 On this rental terms Dutch law applies. Any disputes should be submitted to a competent court in Netherlands.
